FormNut Terms Of Service

GRANTING OF LICENSE.

FormNut.com, as "Licensor" or "FormNut", grants to you, the "Licensee", a non-exclusive license to use this hosted software (hereinafter referred to as the "SERVICE") in accordance with the terms contained in this license.

COPYRIGHT.

All title and copyrights in and to the SERVICE, including but not limited to any images, texts, and sounds incorporated into the SERVICE, are owned by FormNut or its suppliers. All trademarks are property of their respectful owners.

PAYMENT.

If you have registered for a paid account with the SERVICE, your payment for all services will be processed by a third party credit card processor such as PayPal and 2checkout, Inc.

ALL SALES ARE FINAL.

All sales made on, to or through FormNut are final. By submitting the signup or purchase form, you hereby agree that you are an authorized party, and that all sales are final. FormNut is not responsible for any business conducted between Licensee, 2checkout and PayPal. FormNut makes no claims or guarantees, of any kind, regarding any transactions between Licensee, 2checkout and PayPal.

PROHIBITED USE.

Using the SERVICE to send any form of SPAM is strictly prohibited. Any Licensee of the SERVICE found spamming or engaging in fraudulent activity will be immediately removed from the SERVICE and no money refunded.

The SERVICE must not be used to commit fraud nor to be used for any illegal or unethical activities.

DISCLAIMER OF WARRANTY.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. FormNut DOES NOT WARRANT THAT SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FormNut DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF PERFORMANCE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FormNut BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION OR LOSS OF BUSINESS INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF FormNut HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ACCOUNT TERMINATION.

FormNut reserves the right to terminate Licensee's account without notice if the Licensee does not use the SERVICE according to these Terms and Conditions or to Licensee which we, at our sole judgment, think is inappropriate to be a Licensee of the SERVICE.

MISCELLANEOUS.

This document shall be construed in accordance with the laws of Slovenia and the European Union. You agree that jurisdiction over any disputes arising in connection with your use of the SERVICE shall be exclusively within the courts of Slovenia. You agree that the prevailing party is entitled to recover attorney's fees in connection with the successful enforcement of these Terms and Conditions. FormNut may modify these Terms and Conditions upon reasonable notice to you, and your continued use of the SERVICE shall constitute your acceptance of such modifications. If any of the provisions of these Terms and Conditions are found to be unenforceable, the remaining provisions will remain in full force and effect.
